Georgia Man Shoots and Kills Driver Who Mistakenly Pulled Into His Driveway . . . Allowed To Plead To A Single Misdemeanor With No Jail Time and A $500 Fine
There is a surprising plea deal in Georgia this week where Philip Sailors, 69, was accused of responding to Rodrigo Diaz pulling into his driveway by mistake by shooting him in the head and killing him. Sailors has now been allowed to plead out on a single misdemeanor for involuntary manslaughter with no jail time. He was facing a murder charge. Under the plea bargain, Sailors will serve 12-months’ probation and pay a $500 fine. What is equally striking is that Sailors declined to say a word of apology to the family of Diaz when he appeared in court to accept the plea bargain of lifetime.
Diaz appears to have pulled into the wrong driveway while following a mistaken GPS in January 2013. He was trying to find the driveway of his friend across the street to go roller-skating. When Sailors saw a strange car, he came out shooting: firing once in the air and once through the windshield of the car. The second round struck Diaz in the head.

Sounds like murder.

If I kill everybody that turn around in my driveway, I would be considered the worlds greatest (non military) mass murderer. ;-)
This is not good. I live in a cul-de-sac and people are constantly turning around in the circle and all of the driveways in the circle.
To date, no one has died or drawn fire.
It’s a good thing he didn’t refuse to bake a same-sex wedding cake or he could have been facing a much stiffer fine.
If this went down as reported, this is a serious miscarriage of justice, it should have been a murder charge. Unlike, say, George Zimmerman and Trayvon Martin, which I’m sure many on the Left will attempt to compare this to.
Yeah, I can’t imagine a scenario where this is a good idea.
If the story is as told, this guy rightfully should be on death row for murder.
I don’t care how many No Trespassing signs you have up, or how strongly you believe in property rights, shooting someone who simply pulls into your driveway means you are a psychopathic fiend who needs to ride the lightning.

Georgia has had some messed up cases this year (baby with face blown off / kid blown away for answering the door with a game controller ...)
The victim’s family should be outraged that the DA is allowing him to plea down to a small fine and probation. He murdered that boy. A normal person doesn’t just start shooting at strangers who pull into his driveway.
The story, even at the Turley site, is amazingly short on facts, long on emotion.
I’d say, based on the scant evidence, that the DA knows something Turley doesn’t want to tell us, and that the homeowner made the correct decision.
As I can already see the ‘pile on effect’, when you come to deride my comments, provide additional evidence supporting your arguments.
I agree with the posts put up so far. All I can add is that the Diaz’ family is magnanimous and has class and the Sailor family does not.
Why bother?
There is something missing here. Its a rural home, and what time did the shooting occur? OHHHH,forget it, its some old white guy, probably a Tea Party Member who shot and unarmed kid. So, can we riot and steal stuff out of the stores because he was given a light sentence? Will the victims parents make T Shirts to sell with Justice for....?? s/
I hope Mr. Turley is providing all the information for us to appropriately understand why this “deal”.
Mr. Turley is a liberal in academia representing the interests of Republicans on the ACA that “conservative” legal interests shied away from.
This article is apparently from his blog. I get a feeling this article is meant to create fear/distrust of neighbors with guns.

dosn’t sound like the guy had any cause to come out shooting.
it’s funny but the last few years i try t avoid driveways and do a quick y-turn in the street, when possible.
How is that not murder?
I think Turley’s purpose was to cast a bad light on stand your ground laws but by his own words he negates any argument for that.
