An impostor illegally used a New Mexico's man vote three days before the actual person came in to vote. The incident occurred in Rio Arriba County. When the real person came to cast his ballot, he was at first turned away, being told that he had already voted.
Only when the real person contested, saying he had not in fact voted, did election officials review their files and compare the signatures they had on record with the one signed by whoever voted three days earlier.
The signatures did not match. Why the officials did not check this in the first place has not been stated, and required voter ID laws were not in place.
Bobbi Shearer, who works for New Mexico's Secretary of State, stated, "Under current law there are no means available to poll workers to help them determine if a voter is actually the person he says he is."
The actual voter was then able to cast a provisional ballot, but election officials have not decided whether it can be counted.

That is correct to issue a provisional ballet and then have the two parties decide together if the provisional ballet is cast by the person voting; in this case the electronic vote will be tossed out.
I have no confidence in the USA voting system on a national scale. I’m fairly confident in my local polls, but when it comes to Chicago and the like, I have zero confidence. I don’t know anyone who does.
As far as modern technology goes, it should be fairly easy to ensure one-man/one-vote with multiple layers of security, accountability and redundancy. Almost laughably trivial. We vote electronically as stock-holders. We bank online. Why do we not pick a username & strong-password and register an email address, cell-phone, home phone etc when we register to vote -AND IF YOU DO- why is that not used at the polls to determine who you are? Two-Factor authentication is fairly simple to implement, easy to use and darned hard to thwart.
But would the public and the political parties go for that? I don’t believe so. Not today.
So, short of paper ballots, hand-marked and then dipping a finger in ink to prevent me voting more than once — like some third world hell-hole — I have no idea how to fix it.
Yep, that’s a weakness in the law in NM. Does even a legitimately spoiled ballot, which is destroyed, have to be recast provisionally?

Yep. Everyone should just go down and claim to be someone else and vote.
What do you figure than in a lot of places, the registered voters *not* crossed off the list by the time the polls close, will all vote demoncrat in late-night voting marathons.
A legitimately spoiled ballot does not HAVE to be recast, but CAN be recast, but that doesn’t make it a provisional ballot. Also, at the polls, every spoiled ballot, and the voting permit, is placed in it’s own envelope. In addition, if that same voter legitimately spoils another ballot or more, those too are placed in that individual envelope. Those envelopes then go to the county clerks office after the polls close. Not sure what happens to them from there.
With the new machines in my county, the ballots must be filled out with a Sharpie. So I anticipate having to spoil many many ballots as there certainly are plenty of registered voters who do not know how to vote. The common ‘mistake’ is the voter will vote for multiple candidates for the same office. When the ballots could be filled out using a pencil, frequently they could just erase the additional candidates.
The theory of what she did [and what ultimately caused the "why would so many people vote for two candidates in this county?" fiasco] is that she ran a hole-punch through Gore's name on all of the ballots after they'd been cast, but before she showed up at the county courthouse on election night.
Now this is diabolically clever because 1) No Gore ballots are affected by it. They already have a hole 2) Every non-Gore ballot was invalidated by it [because now they have two holes] and 3) it lent weight to the preposterous claim that the ballot was so confusing that people didn't know for whom they were voting -- there were enormous numbers of two-holed ballots that had to be thrown out.

Then they play a semantics word game by pretending to be in tell ect u all by saying it’s “election fraud”.
Not that I am advocating voter fraud, but it would be interesting if someone(s) went and early voted under the name of several prominent politicians during early voting. I wonder if their views on voter ID would change.
If the legitimate voters vote isn’t counted, there should be a good equal protections clause case to run with.
We need to start using the Judiciary as the Dems do, push up vote fraud cases under the Equal Protections banner and try to get rulings that FORCE recalcitrant states to implement voter id/ballot protection measures.
Even if we lose those cases (given the Obama-packed judiciary) we’d still have documented cases of vote fraud being persued in the system. There’d be no denying that they were happening.
