'Beliefs and commitments' of nation's leader should supersede judges - The interpretation of federal law should be made not by judges but by the beliefs and commitments of the U.S. president and those around him, according to President Obama's newly confirmed regulatory czar, Cass Sunstein. "There is no reason to believe that in the face of statutory ambiguity, the meaning of federal law should be settled by the inclinations and predispositions of federal judges. The outcome should instead depend on the commitments and beliefs of the President and those who operate under him," argued Sunstein.
This statement was the central thesis of Sunstein's 2006 Yale Law School paper, "Beyond Marbury: The Executive's Power to Say What the Law Is." The paper, in which he argues the president and his advisers should be the ones to interpret federal laws, was obtained and reviewed by WND. Sunstein debated the precedent-setting 1803 case, Marbury v. Madison, which determined it is "emphatically the province and duty of the judicial department to say what the law is." He lamented multiple recent examples of U.S. presidents interpreting law only to have their interpretations overturned by the Supreme Court.

Sunstein’s comments are truly bizarre.
Gosh, I was sure the Constitution set up three branches, with separation of powers.
I knew Sunstein was a real kook when I saw all the liberal wackos and some “conservatives” out there saying that he is the smartest man ever to have lived. That’s usually the way they provide cover for the morons they hire.
This is exactly what we need... for the administration to piss off the judicial branch.
Separation of Powers.
Commies want laws to be as vague as possible thereby giving them as much power as possible when they take charge.
That is so sad.
So this guy writes the above in 2006 and gets confirmed with GOP senators voting FOR him and McDonald is going down, down, down in VA because of something he wrote 30 years ago.

The Constitution states the congress makes the law... Judges have disregarded congress intent of the law congress makes and have claimed only they will say what a law does... congress be dammed
Now this nutball claimed the President only will say what a law does... congress and the courts be dammed
We just gone back to the king/dictator model of rule, they are is not only above the law they are the law!

With the dictator-judge and his dozens of “czars,” Congress and the Supremes had better wake up to their impending demise soon.
Might Sunstine be concerned the judges he considers useless might want to delve into the birth issue for the potential dictator before he terminates them?
And what about Sotomeyer (never mind, if she's not a judge, she could be the new amnesty czar.....) sarcasm....
On the faces of some people, the Evil that dwells within them is so clearly visible.
Cass Sunstein is one of those people. His boss is another.
When I first saw a picture of Cass, I immediately thought to myself that I would not let this man around children at all. He looks like a creep, but even worse, like a ghoul,like some villain from some horror movie.
Now that I have become more familiar with what dwells in his klingon like skull, I am convinced that this individual is absolutely without a human soul. He, much like his boss, is the purest essence of Evil. We must not allow an individual such as this to be in our government, much less the SCOTUS. He must be stopped. He is a seed of corruption just waiting to spread his roots once planted by the Devil in the garden of America the beautiful.
This nutbar is in a position to do much more damage than Van Jones was, and the Senate gave him their stamp of approval. God help us.
