Bush is like the vast majority of politicians -- he's afraid he'll lose votes if he comments either way so he takes the easy route.

I don't know how old you are, but I remember when President Nixon made a comment about Charles Manson's guilt while the trial was on-going. All hell broke loose, quite literally. Manson managed to get his hands on a copy of one of the LA newspapers with a huge headline that said something like "
NIXON: MANSON'S GUILTY" and waved it around to the jury. They almost declared a mistrial.
This is why Presidents refrain from commenting on cases pending before any court, civil or criminal.
