Why? This was physical assault. I thought that was a felony. Since when are you ticketed and released for a felony?

Depends on severity and local law. In Texas for example, a finger poke to the belly would be simple assault. A finger poke to the eye might qualify as aggravated assault if it sent the victim to the emergency room.

I have no idea what qualifies in Kali.

I abhore these so-called pacifists. Anyone who desecrates a 9-11 memorial is mighty low.

I was thinking precisely the same thing. Something stinks in this town from the mayor who won't comment on a fellow Latino(judging by the names) to the police who are bending over backwards to protect the vandals from prosecution. This is an outrage!!!

The fact that this woman Jennifer Quintana was booked on misdemeanor assualt insted of felony assault says a great deal about the nature of the conflict here in the USA. The local police department is bending over backwards to not arrest any anti-war people and their refusal to take the vandalism complaint from the proprty owner is a further example. Personally, I would have prefferred it if the woman assaulted had engaged in full self-defense after the assault and kicked this little piece of dung's butt.

Instead the Police department is contributing to an escalation of overall tension by first allowing the vandalism to stand. Second, they are showing the American people that they can not expect protection even for their persons by not charging felony assault and an attempt by Jenifer Quintana to deprive Tracey Chandler of her civil rights (free speech).

If this continues unabated expect an explosion in this nation.

CALIFORNIA PENAL CODE
SECTION 594-625c

594. (a) Every person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law, is guilty of vandalism:

(1) Defaces with graffiti or other inscribed material.
(2) Damages.
(3) Destroys.

Whenever a person violates this subdivision with respect to real property, vehicles, signs, fixtures, furnishings, or property belonging to any public entity, as defined by Section 811.2 of the Government Code, or the federal government, it shall be a permissive inference that the person neither owned the property nor had the permission of the owner to deface, damage, or destroy the property.

(b) (1) If the amount of defacement, damage, or destruction is four hundred dollars ($400) or more, vandalism is punishable by imprisonment in the state prison or in a county jail not exceeding one year, or by a fine of not more than ten thousand dollars ($10,000), or if the amount of defacement, damage, or destruction is ten thousand dollars ($10,000) or more, by a fine of not more than fifty thousand dollars ($50,000), or by both that fine and imprisonment.

(2) (A) If the amount of defacement, damage, or destruction is less than four hundred dollars ($400), vandalism is punishable by imprisonment in a county jail not exceeding one year, or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment.

Right. If it was Mayor Smith who had "no comment" on obvious boorish behavior by some guy named Jones, I'd wonder what was up.

Aren't we conservatives always decrying liberals like Jesse Jackson when they find and inject race into everything? Why inject race into this incident when there isn't anything (that I can see) that indicates that race is a factor beyond the sound of their last names?

I would bet the police are getting heat from the mayor's office to overlook the seriousness of the crime. I wonder if the property owner, since the police have totally changed their take on this, can contact other authorities for an investigation regarding civil rights violations (I don't think that the best thing to do, but in this instance it seems use the liberals weapons against them is warranted).

My guess from 3,000 miles away without knowing anything about the community is you are correct about the mayor's office. My opinion is that unless the pro-Saddam protestors are prosecuted this will only add to the residue of latent anger in the body politic that will eventually find an outlet. The police in this town need some changes. They need to do their job and not let pro-left politicians stop them from enforcing the laws against the anti-Americans. I agree that the civil rights laws should probably be invoked but I do not think that will happen.

You're forgetting one crucial fact - "Mayor Smith's" police department has arrested and charged "Jones" with a crime. As such, "Mayor Smith" represents one of the parties in the upcoming court proceedings, and probably didn't want to say anything that might possibly affect these.

Please don't play the race card until the facts are in.

Actually I understand the Police were on scene and had to restrain the crowd from killing this fruit cake. Maybe someone that was there can confirm this.
