What's wrong with ballot initiaves? Nothing if you want to open a whole can of worms. The reason Bush could not support that initiative is that it would have made an end-run around numerous state and federal laws and that he swore an oath to uphold.

Alligator Alley is in Broward, not Dade. You're right. Broward and Collier county.
However wetlands legislation affects the whole of South Florida. You're a smart guy, dig a little and you'll find that the entirety of environmental law is based on treaties. Not legislation and rarely voted on in public.
For example check the dates and times of most environmental/treaty law votes. Generally they are made late at night on the last day of a session.
Does that sound like a transparent body?
And this is why it is important that control of issues like these be turned over to the States. So people can vote Senators out.
And they call libertarians utopians. Want to see who can hold their breath longer?

dunno, I always considered them as fulfilling part of the Tenth Amendment. On the surface yes but when a ballot initiative is in direct conflict with federal law the constitution gives supremacy to the Feds. That is exactly why the various pot laws have gone nowhere because no state government will defend a law passed outside the legislature.

I can see their reluctance to take on the FED, believe me.. But a little defiance would be a nice way to keep FEDGOV in it's constitutional box.
Like Davis saying Cali has the right to impose higher pollution standards than the EPA calls for. He doesn't admit it straight out, but he's making a "States Rights" argument and defying the FED.
I also think he's right. (I can't believe I said that..)

You would be suprised how often I decline to opine on the merits of a matter, whether it is because I don't post at all on a matter, or, as is often the case, I actually post that I am not sufficiently informed to opine, or simply ask questions. Granted such declination posts are not made quite as often as when I do choose to opine, but I suspect I have more declination posts than most. Whatever.
