Would you rather have the little murdering SOB set free because of a technicality?

No way! But since they know little about this person, (illegal alien stowaway) he hardly looks 17 years old. He looks like a man to me. Here in Michigan, an 11 year old was charged as an adult for murder. I guess my question should have been, because this Jamaican is classified as a juvenile, and his records, so far, are sealed, will/could he be given the death penalty?

I believe he will eventually be declared an adult, probably by several jurisdictions. I think that at this point all of the LE's are being super cautious in everything they do, 'cause they don't want to screw it up.

BTW - I heard on Fox that "the suspects" were interviewed for 5 or 6 hours yesterday. It doesn't sound like they are waiting for parents for Malvo.
