I don't know if the Torch can appeal or not, but I'd kind of hope he did. Like the RATS wanting to get Saddam off the front page, he wants this issue to go away.
But with Lil' Tommy Dasshole foaming at the mouth about Iraq, the RATS attempts to demagogue the economy and social security are lost in the shuffle. Same thing applies for Torricelli.
By dragging this out, it keeps the issue on the front page, and implies that he's hiding something from the voters. By the same token, if there wasn't some damaging evidence in there, he would have released it himself. It's a lose-lose proposition that only gets him in more trouble the closer we get to election day.

I lean toward your reservations. The Torch is a criminal enterprise choir boy and the criminal enterprise wouldn't allow him to be exposed if there were enough in the memo to threaten dim control of the Senate.

I've seen the ads - they're great. The only motive I can see for the media pressing for the release of the memo is that the NYT, et.al., already know the dems will lose the Senate and are making the Torch the sacrificial lamb.
