On the likelihood of a Court test and overturn: I disagree.

This is a fairly conservative Supreme Court. Also, the Court dislikes intruding on a deeply felt political issue. Popular pressure forced politicians to declare the war on drugs, not the other way around. The Court's highly sensitive politically, especially after the 2000 election fiasco.

Why? Do you agree that the federal government has no Constitutional authority over the intrastate making, distributing, selling, buying, or using of any drugs?

The reason I think it would be overturned is BECAUSE it is a conservative supreme court, Renq, Thomas, etc are very much into State's Rights. Liberals love the drug war, they started, they are going after their new drug (nicotine). It gives them control, money and power.

We have an extraordinarily different view of the political landscape regarding drugs.

Drug traffickers and users have such a negative public image, only a handful of politicians will line up with the drug lobby publicly. Especially, that includes the Court. Yes, local law enforcement accepts bribes to overlook growing and transport in some jurisdictions. But taking positions that can be seen as supporting the lobby is the kiss of death politically.

SC is safe from the drug lobby public unless they think Congress would impeach them. In all likelyhood, they'd just pass an amemdnent, which they should have in the first place to do so if the USSC ruled they (feds) have no jurisdiction over intrastate commerce.

Btw, you are not thinking correctly, drug traffickers LOVE the drug laws, they KEEP their jobs because of it. In the white market, The Budweisers of the drug industry win, not the gangs from Columbia, etc. I agree that they have negative public image, most of it though has come from government propaganda for the last 60 years.

Try this one, 1938 the year after marijuana was criminalized, Marihuana More Dangerous Than Heroin or Cocaine:

The drug war propaganda at its finest.
