NIH is not an independent agency. It is an agency under HHS.

Well, you do appear to be correct on both counts in this regard, but probably only by coincidence, given your total disregard on this thread for factual information. However, it is still clear, however, that NIH does have some independent authority not directly subject to the Secretary's control, as outlined by the 1993 act.

Sorry, you are wrong. The NIH is not a loose canon. It has to follow strict laws under the Public Health Service Act, and several other Congressional and HHS guidelines. If you pick up an Admin law book, you can read that ad nauseam. The President nominates the head of the NIH, who reports to the Sect of HHS. All the grant money for research is actually allocated by the HHS (I am not 100% sure about that). As such, if Tommy T felt that fetal stem-cell is not a good idea, he didn't have to earmark a dime for it.
