Someone could 'reasonably' get a helicopter and get the same pics from scaling the 8 foot wall.

As everything else, it's a judgment call. If I were the judge in this case, I'd say that Mrs. Pitt certainly expected privacy because the photogs had to scale an 8-foot wall in order to get these shots. I'd rule in her favor.

After Jennifer has already showed her assets in national magazines, why the big fuss now?

Maybe it's not the nudity, but the feeling of being violated by the paparazzi? That's my guess.

If you were photographed with your consent and somebody ran it in a newspaper, does that give somebody else the right to peek in your window or climb over a security fence to get another shot without it ? I'm not especially fond of entertainment celebrities, but everybody deserves privacy within the confines of their home.
