If a space vehicle is a vehicle, why isn't an airplance.

Lawyers and politicians make up their own dictionaries as they go along. "That demends on what you mean by 'is'". <P. A particularly favorite tool of the leftists in their mission to tear down society, and rebuild it in THIER image.

Just a wild-assed, off the wall guess, but they probably don't have any evidence at all linking Reid to the 9/11 conspiracy.

Doesn't matter. He was involved in another conspiracy, by the same conspirators.

My point is that we used to justify and excuse military tribunals on this very website with the line..."they are not trying US Citizens. Non-citizens should not have constitutional protection."

Now we are seeing what, in a pessimistic view of government in general, could be considered the extension of the suspension of the bill of rights to include US Citizens. It isn't hurting you or me right now, but if we sit and let it happen, it might hurt us in the future.

Richard Reid and Pancho Alqaida represent the new wave of Islamic fundamentalist terrorists.
Yeah, Am I the only one who thinks this war is already halfway won? The evidence is obvious. The Golden Boys of Al Qaeda are shut out because everyone is looking over their shoulder and now Al Qaeda resorts to using flunkies. In the end, what will they use? I am not worried about any internal (US) sabotage unless it is with some biological, chemical or nuclear weapons. I only worry about these being smuggled in, undetected. In the case of nuclear weapons, a bit harder to smuggle but no need to smuggle if you can just get it on the shore, if you detonate while in port. I believe the president when he says WMD is the real threat. There is no doubt about it.

Once a U.S. citizen allies himself with a foreign enemy bent on the destruction of other U.S. citizens, I think we should consider his citizenship renounced.

Young said he looked to a legal definition of "vehicle" drafted by Congress, which says that a vehicle is something used as a means of transportation on land.

I thought that airplanes taxied before takeoff and after landing. Is this not a means of transportation on land?

Ok, but who makes the determination that your citizenship gets revoked?

a. Me?
b. You?
c. John Ashcroft?
d. A military tribunal with no right of appeal?
e. A civilian court of law with due process?

The judge said the new law does not define the word vehicle.

Maybe the judge could use a dictionary:

"any kind of contrivance, on wheels or runners, used to carry people or goods from one place to another over land;

Remember it is one of nine charges.

A common tactic with law enforcement is to charge a person with as many possible offenses as they can. It loads the case, pads it - so to speak - in case the courts throw out one or more charges. These acts help to insure a conviction on something.

A lesser included effect is to complicate and distract the defense team.

"Reid's motion to dismiss (the charge) is allowed because Reid's alleged actions are not within the scope of conduct prohibited by (the USA Patriot Act)," Young wrote. Young said he looked to a legal definition of "vehicle" drafted by Congress, which says that a vehicle is something used as a means of transportation on land. "It is not a 'vehicle' as that word is used by Congress," the judge wrote in his 24-page decision.

That's what those 100+thousand dollar a year congressional aides (the ones that actually write these bills) get you. Then again, considering the limited intelligence of some of our elected officials, how can we expect them to hire people bright enough to actually remember to define a KEY TERM in a criminal bill....

Love a duck!

it has to be a Vehicle AS DEFINED BY CONGRESS.

An Amended Definition should have been in the bill.

First the Reids and Alqaida's of the world are not the new waves. They are just the newly discovered waves. These traitors and I do not use the word as lightly as many do in this forum, have been sleepers for a long time. Secondly, if you believe that this war is half over then you need to get a crip and stop listening to the political spin doctors. This war is just getting started and AQ is very prepared for the long haul. Third, you better be worried about internal sabotage a lot of damage and death can result with convention explosives and devises. We can detect the nuclear stuff, but remember its a big country. The bio stuff is an entirely different story.

Do not get to comfortable, we have a long road ahead.

Yes this is my concern. for the life of me I do not understand why the President did not give the military tribunals the authority to handle Americans in certain cases. Not all cases but ones like these should be directed to a military tribunal. However doing it the way we are right now all Americans need to be concerned.

Depends on what the meaning of the word "is" is. This just makes the Honorable Judge look like a first class Clymer. Or a traitor. But I guess he's O.K. with that.

U.S. District Judge William Young agreed in part, ruling that although an airplane was engaged in "mass transportation" it is not a "vehicle" as defined by the new law. The judge said the new law does not define the word vehicle.
