Reconciliation is supposed to be limited to budget matters. Substantive legislation is supposed to happen through regular channels. The parliamentarian is probably right as a matter of the rules.
The immediate reality is that several red states attempted to enforce immigration laws during the Obama and Biden adventures in executive nullification, and Obama and Biden immediately sent their flying monkeys into court to block state action. Trump won’t do that. As long as Trump is in the White House, states will have broad latitude from the executive to enforce the law. The theat will come from activist judges, but not Trump or DOJ.
Yes, it would be important to lock this down in statutory law, but reconciliation is not the proper place to do it. The Senate parliamentarian does not have unlimited discretion to rewrite the rules on the fly ... although that standard, like all traditional norms, has been taking a battering in recent years.
A restoration of regular order would be a good thing across the board, especially in the authorization and appropriations process on the budget. Pass the budget in regular order and get rid of the constant CR’s and Omnibus bills that are presented as massive take it or leave it deals that no one has read. The collapse of the budget process has gutted the opportunities for most Members of Congress to conduct routine oversight and continuous adjustment of spending. The big spenders like it this way because the normal channels for budget discipline are eliminated. They are placed in a constant kabuki dance of Perils of Pauline, strike of midnight votes on CR’s and Omnibus bills, and if they don’t pass the whole package with all the garbage, they will trigger a government shutdown. The democrats are convinced that they will always win the politics of shutdowns. Historical experience suggests that they are correct.
Therev are always so-clled republicans looking for ways to avoid acting in the interest of voters and ways to weasle out of doing anything that offends democrats.
