While these are matters of national security, judges of all stripes are behaving in a manner suggesting the executive branch cannot make policy, that policy is up to the courts; with the courts behaving as super-legislatures via judicial fiat.
The constitution has a remedy for executive branch policies someone does not like. Its called elections.

That’s not really how the judge ruled. He ruled the illegal cannot be detained under the Alien Enemies Act, but can continue to be detained and processed for false statements on his Green Card application……which would be a deportable offense.
