“Fraud” is a rather broad term, one can commit fraud without money changing hands. The legal definition is going to vary somewhat between jurisdictions, but money is not a prerequisite for fraud.
Yep, no mention of “random giveaway” on the petition website “fine print”...no mention of “random” by Elon in Tweets...apparently he only mentioned “random” in a speech on Oct. 19th. I would think the website “fine print” is the bottom line/overarching policy.

Musk’s “random” claim may not be binding, but why would he say it if it wasn’t legitimate? If he wants the trust of his and Trump’s supporters, why do this?
