Nope. The President’s pardon power under Article II, Section 2 of the Constitution is limited to “Offences against the United States.” Most state governors have the power to pardon state offenses, but many are limited (e.g., in Georgia, you have to complete your sentence AND pardon must be recommended by the pardon review board before the governor can issue a pardon).

Federalism. It is why both the state and feds can prosecute you for the same crime. If you are acquitted in state court you can still be prosecuted in federal court and visa versa and no double jeopardy defense will apply.

I would like to see the take away on this is that the 4473 (the form in question) and the whole NICS system is revamped.

I Assume that the gove can search me, or anyone, and find out everything, and I mean everything.

Once the potential buyer’s identity has been verified, the gov should be able to easily assess a pass fail based on their records and history.

The 4473 questions on the form is, essentially, a perjury trap.

Hunter will get probation. Joe’s last act will be to pardon Hunter. Joe’s not going to last much longer, so he’s not going to worry about his good name or his legacy (if he ever did). The media and historians will call the pardon the deathbed act of a devoted father, and (if they are really keeping count of Joe’s broken promises) it will be forgiven.

I know that’s what it says. But in practical terms a US President has plenary pardon authority. History proves this. And of course a President can make a call to a State Governor. What, are you now going to argue a State Governor doesn’t have pardon powers?

C’mon.

None of that is the issue I was raising. Everyone agrees that Hunter violated that provision. The argument is whether it should be a law in the first place. Why could you not make the same argument for a guy that has a couple of beers after work every other day?

He was sacrificed for the “greater good” — A) directing the electorate’s attention away from the family’s international influence peddling business (10% for the big guy), and B) attempting to show that the justice system treats Dems and Pubs equally.

And the sacrifice is minimal anyway — it’s doubtful he’ll get prison time, and even if he does he’ll be pardoned by the big guy right after the election, regardless of the outcome.

Yep- looks like that is what is gonna happen- you can bet that if one of the Trumps received money from china, ukraine etc- no matter how little, the left woudl be all over it till they were convicted
