Note the court upheld the act but most people now agree with Scalia. And his dissent is the best explanation of the separation of powers ever penned.
The issue now is that Congress has passed laws telling the executive branch how to hire, fire and enforce the laws. (e.g. the Administrative Procedures Act). That’s why Trump couldn’t overturn DACA. In my opinion this situation is still unconstitutional, but be that as it may, apparently Garland didn’t follow all the steps in the law when he appointed the special prosecutor. I haven’t followed it closely enough to know what steps he (presumably intentionally) didn’t follow.

So, you’re saying that Merrick Garland’s appointment of Jack Smith as Special Counsel was lawful and Rep. Massey was wrong to chastise him?
