I meant the verification of identity is the number one priority, not verifying ownership. I see how my comment under that quote could be misconstrued.

I don’t use my notary stamp very often, but I’ve had it for 25 years.

Well yes they can and do. Which is why preventing fraud is so important as is quick legal recourse when it happens. Having to wait months to go to court to evict someone who claims they are a legal tenant or owner is an unfair hardship on the rightful owner.

Fraudsters are getting better at producing documents that look legit without rather in depth investigation of not only the contents but materials used.

Nope. Maybe in some city but it is 15 years by state law.

No, both by state law. The 3 days was in response to another comment on landlords being stalled on initiating eviction orders. That is very quick in CT.

I read the state law. The minimum amount of time to establish adverse possession is 15 years. Not sure where you are getting your information from.

Whoops sorry about the mix up. I thought you were referring to how long it took to make a claim of adverse possession. You meant to go to court for eviction.

From the Dekalb Superior Clerk website:

All Deeds of Conveyance require a PT-61. Payment of transfer tax is required at time of recording if not exempt. Authority O.C.G.A. 48-6-1; 48-6-2. PT-61's available online at www.gsccca.org/file. Form must be completed online, printed and submitted with deed at time of recording.

ALL deeds of conveyance must have the Tax Parcel ID #  shown at the top of the first page to be eligible for recording.

- We do not provide forms for filing
- Documents must be complete before recording.
- Most documents must be signed, witnessed and notarized.
- All deeds of conveyance must have a printed,
complete PT-61 (can be completed online, GSCCCA.org/file or in the Real Estate area of the Clerk's office.)
- State Identification is required for any filing.
Georgia Requires Tax Parcel Identification for all DeKalb Property Transfer or Conveyance Filings as of July 1, 2019 in accordance with House Bill 694 (HB 694).

It’s doubtful that the entire transaction can be done online, as the article states; in fact these instructions indicate that the form must be “printed and submitted with deed at time of recording.”

I am not sure just how closely the recording clerks check documents. They probably notice little besides from glaring scrivener’s error or omissions on the documents themselves.

That is why it is a good idea to periodically check your property records both with the tax office and the clerk of court. In most places this is easily done online.

Very good advice in these times, as there’s enough malfeasance to go around anymore.

Oftentimes these ‘news’ articles present a scenario with few details. If the Superior Clerk’s office messed up on this, I would think there’d be ramifications, especially from homeowners in Dekalb county. There should be an investigation to identify what actually occurred. But I doubt that will happen with this story.
