If someone EVER pulls a gun on me, and I can get it away, I will empty every round in it into them or into the people with them.
The *only* appropriate response to any threat is to terminate the person making it.

As a former Police Officer and a student of the law I feel that your interpretation is correct. In any “murder” you have to show either premeditation or “mens rea” which literally means “evil mind or evil intent”. I see none of that here!! If “their” intention was to kill him regardless, the father could have shot him. The only time the gun was discharged was when Arbury charged the son. Arbury could have run away but he decided to “attack” instead! An appeal needs to be filed immediately. Bad verdict!!!
Normal people don't drive down a neighborhood street with a shotgun in the cab and another guy standing up in the back bed of the truck.
From the Georgia murder law: "A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being." The prosecution said that the fact that the McMichael's illegally chased Arbery down the road indicated malice. But even without that, the law states, "A person commits the offense of murder when, in the commission of a felony, he or she causes the death of another human being irrespective of malice." The McMichael's were also charged with false imprisonment, which is a felony.
The McMichael's will appeal, but they're not going to have an easy time of it.
