No thanks to Perry, Texas already allows illegals to be eligible for in-state tuition. Now, they could get there for free.

You're mostly correct. But, it takes a while to establish residency, or at least it did ten years ago. Maybe a year before the application, so closer to two before school entry.

I don't know the exact details, but I have a niece that did that (she was following her grad-school boy friend) and went to UT grad school. It took a while; she couldn't just move there and apply as a resident.

Of course, if you're an illegal, at many schools state residency is irrelevant.
