I watched frame by frame. After two back steps his left foot moved at 90 degrees to the shooter putting the dudes side to the shooter. There was no forward movement.

What you see is ‘sustained attack posture’ was the dude getting hit.

I also can see both sides. If the shooter were charged and I were the prosecutor, I'd show the jury the video and argue that the young guy backed away when he saw the gun and was no longer a threat; and that the older guy shot him because his blood was up and he wanted to hit back. That could be manslaughter.

That said, it's too bad that with a certain subculture in our society, there's a non-trivial chance that any verbal disagreement will escalate to violence. You should be able to point out that a person is misusing a handicapped space without getting physically attacked and having to make a snap decision about lethal force that will follow you the rest of your life.

And don't forget about the 2nd guy that came out of the store, the one in the light shirt. He sits at the door until the assailant has grounded the victim then starts walking towards the confrontation. Maybe he was going to break it up or maybe he wanted to join in. Who knows. If you're the victim there are now 3 people in close proximity.

And notice the difference in behavior between the assailant and the light shirt guy. The assailant responded far differently than the light shirt guy who makes a Bee line out of the area.

If you are on the ground after having been two arm shoved by a larger man with the female exiting the car and dude #2 following the assailant I'd say the danger is both clear and present.

Any detail gleaned about either the event itself or the players can provide perhaps important context.

E.g., now I hear that this guy was a busy-body constantly harassing people about missteps with handicap zones. Like a cop who feels the power and likes rubbing it in. Not that these people were OK being in the space, but the point is it sounds like he tends to be pushy and perhaps a bit of a power-hungry do-gooder.

Ipso facto, his trigger finger may be in question.

What I take away from this video is never talk to strangers unless they are doing something that directly and immediately effects you.

I didn’t realize the parking lot being full was a valid excuse for parking in a handicapped space?

Seems like a pretty simple situation that got terribly out of hand.

Yes, this exactly. It's called civilized society.

Unfortunately that doesn't appear to be the world we live in. I've been thug bumped two times in my life, including once on a US Army base, words didn't help me. Hell, I had a dude brandish a gun at me because he saw me shake my head in disgust when he threw his fast food trash out at a stop light. That's why I carry and that's why I side with the victim.

I respect your opinion a lot, and did that - watch the vid slowed down to clearly establish the sequence of actions. You had me pretty well convinced. What I saw:

The deceased blindsides and knocks the shooter to the ground, hard.

Shooter recovers (to sitting position on the ground) as deceased continues to advance and take threatening stance. Girlfriend has backed off and does not again advance.

Shooter begins to go for gun - deceased recognizes this, his advance halts and reverses. THIS is the beginning of the shooter’s “retreat”: The time from the push to this instant all fits under “threatening stance” by the deceased. At the beginning of the retreat it looks to me as though the deceased is 3’ or slightly less from the shooter — the angle could be a bit deceiving. Certainly the deceased is VERY dangerously close and in an aggressive posture up to this instant.

Shooter visibly produces gun - deceased continues to retreat.

Shooter carefully (considering the circumstances) takes aim - deceased continues retreat but it slows and he moves slightly to his right - shooter continues aim and fires once.

(Fatally wounded) deceased flees to store.

Now, looked at that way, I agree it looks bad for the shooter, and it appears he shot in retaliation for the knockdown.

However, then one has to replay the vid again a few times in “real time”, and put oneself in the shoes of the shooter as someone who likely has little training in simulation of such an event, including “I” have just been violently & unexpectedly knocked down, and who knows how high my adrenaline just went. Put another way, I’m NOT trained in getting off quick, accurate shots, or not, in a high stress situation including physical shock to myself, and I doubt the shooter was either. In that context, this happened FAST, and I really doubt the shooter had time to evaluate more than “survive”, “take good aim” (at a somewhat moving threat) and “fire”. There’s just not enough time to really “think” about what the deceased is doing from the time the gun is pulled out, to the shot, unless the deceased does something really obvious like throwing his hands up in the air.

Now... I know some FReepers claim to have lightning fast brains that can accurately assess and respond to all aspects of any unexpected situation in a second. Most of us humans are not in that category. :-)

Don’t forget about the guy following the assailant out of the store after the shove. Freeze the frame at the 20 second mark of the NYP video and imagine yourself as the victim there.

No, I answered the right question. I just didn’t give the answer you wanted.
If I pull my gun, I’ll do it to stop a threat, and protect my life or the life of my family.
It may be true, that you should never pull your gun unless you plan on using it. However, that doesn’t mean that you are required to shoot even when the person is no longer a threat.

What if the guy turned around instead of just backing up?

Do you think it’s okay to shoot someone in the back?

I would refer you to my previous post. Victum hits the ground @ 19s then freeze frame @ 20 seconds. The victim fired @ second 23. That's 3 seconds between or so between going to the ground, realizing 3 potential hostiles are near and firing.
