Definitely. Ayers got pardoned for his previous acts, but anything he did since 1980 is fair game.
The murder of a San Francisco police officer in '70 or '71 (can't recall exactly when) is believed to have been Ayers's work.IIRC it hasn't been solved yet.Also,that huge explosion in Greenwich Village in 1970 is also thought to be his work.And there's the Brinks robbery in Nyack,NY (suburban NYC) in the 80's in which two cops were killed.
At his trial(s) the prosecution could use quotes he gave in the interview that appeared in the NY Times on 9/11/2001.
As I recall, Ayers was set free because a judge ‘lost’ all of the incriminating evidence against both He and his Wife...so there was no trial.

Several reasons that come to mind: they infiltrated allies into the law schools, the legal system, and Congress early on (going back to before World War I and accelerating with the founding of the NLG and ACLU and the ascension of Louis Brandeis and Felix Frankfurter to the Supreme Court) to give them legal cover; they hold the threat of riots over authorities’ and politicians’ heads; they cultivate wealthy donors with strong politican connections; they gained a stronghold in the media through Franklin Roosevelt’s wartime propaganda agencies; they have blackmail dirt on their enemies; and the labor unions have ties to the mob. There are probably other reasons, too.
