The Republicans don't just have to lose, they have to lose big in order to go down to below 40. Otherwise, they can still block all actions.

Whether they will choose to do so is the real question.

They did allow Obama to appoint Kagan and Sotomayor. They also allowed him to appoint Lynch.

So there is plenty of precedent, unfortunately, for them to do the wrong thing.

Obama has no cards. It’s all up to McConnell and he should not even bring a vote to the floor.

Obama, the libs, and the media will go batty trying to pressure the GOPe to hold hearings, the only question is....

Will McConnell and the GOPe fold again and reinforce why Trump is doing so well?

Earl Warren was a governor with no legal background. He turned out to be one of the most consequential Supreme Court Justices of the 20th century.

Powell would be confirmed quickly and would be a disaster on the Court like Warren was. But, from Obama’s perspective, he would be exactly the disaster Obama wants.

Earl Warren did receive a law degree, and was barred in the state of California. Powell has no such credentials, but I agree that he’d be the disaster that Obama would want to leave as his legacy.
