As part of the constitutional repatriation, the selection and appointment of a non-partisan judicial nomination needs to be taken out of the hands of Washignton, DC professional politicians. If the power rests with the states as suggested by the constitution, then a nominee selected by say the majority of the state supreme courts (1 vote per state) and confirmed by a majority of the state legislatures.

It’s about time he did something. The good news is he will be able to be in the Senate in person since his campaign should be winding down in a few weeks.

There will be a floor vote before January 3, 2017 on Obama’s nominee(s) - I believe Ginsburg’s retirement is now a certainty.

So, the goal is to get 51 “no” votes. This requires hearings upon hearings, it requires a concerted propaganda campaign, it requires pretending it’s not “political”.

That outcome always depends on the nominee. Hatch is the person who propsoed Ginsberg, and you can bet there are several GOP members more than happy to float liberal justices that will make it through committee and an up/down vote.

Of course, the American people elected Obama to be president. Twice. So it’s difficult to argue that that isn’t the will of the American people.
And if the roles were reversed, with a lame-duck Republican president, the same people would be screaming that the President be allowed to get his nominee appointed before departing office.
Hypocrisy is universal.

Agreed. We are getting ahead of ourselves with what’s going to happen.

There is a process which will happen.

Obama will nominate someone, then the Senate will decide what to do.

Let’s take everything one step at a time, people.

dumBO will nominate Biteme, the Senate will feel obligated to confirm one of their own. Obummer will abandon Hitlery, feeling his legacy is assured, even, with a Republican President.

The question will then be, will a liberal court feel the necessity to reign in a Republican President if they ever want to take over the government again? i.e. a limited President will continue into the next Bolshecrat regime.

Yep, I hear you.

The man just died, less than 24 hours ago, and already the media and boards such as this, are full of the political calculus involved in filling this vacancy.

It’s disgusting. There is a time and place for everything, including the political manuvering.

But agree it was classless of Obama to mention that he’s going to nominate a new justice to the court. And classless of all the Democrats such as Harry Reid and their henchmen in the media demanding a new nominee be confirmed quickly. There too, there will be a time and a place to have those fights.

Saw a cartoon depicting Obama gloating over his appointment to SCOTUS on liberal blog.

Hard to do since Obama is no longer licensed to practice law in any state.

Wait until we have a Republican President and Republican Congress. Hopefully next year. Should use this nuclear option. Constitution hang in the balance.

No way Obama would nominate Cruz to the court. Obama will appoint some liberal hack. The question is whether said liberal will be palatable to the GOP.

The GOP has a 54-46 advantage. If they peel off 4 Republicans, then Obama’s pick will be confirmed. Remember Joe Biden would cast the tie breaking vote if the vote were 50-50.

And that’s assuming there’s no filibuster. I thought there was some gentleman’s agreement that the Senate doesn’t filibuster Supreme Court nominees; that all such nominees will get an up or down vote? Though in today’s climate, who knows if that still is true.
