How can it end in defeat? She is doing as her faith leads her to do. That's never a defeat or a loss. Perhaps others will feel inspired to follow their faith more closely, that's not a loss. She is fighting battles bigger than what is seen.

I disagree. The gay marriage imbroglio is of immense importance. It will define our Republican form of government. The federal government has no jurisdiction with respect to marriage. This is brought strikingly clear in the Davis case. Clerk Kim Davis has undressed the district court judge and he knows it. While he can assume the role of a tyrant and illegally throw her in jail or fine her, he can not issue a legitimate marriage certificate, he knows it, and therein is his dilemma. Only states have legal jurisdiction with respect to marriage matters. Clerk Davis is the duly elected clerk of Rowan County, Kentucky and derives her authority from the citizens of Rowan Country. She remains the Clerk and the tyrant judge can not remove her from office, and he can not order her under duress to issue lawful marriage certificates. Furthermore, none of her underlings can do so either, since she has not authorized them to do so. Thus, the marriage certificates that are being issued now without her authority are null and void. I would conclude that the Davis case is where the federal government finally runs into the brick wall of federalism. Accordingly, this case has historic proportions not only on religious grounds but on state rights grounds.

Of course it's not the law. The law is what was passed by the Kentucky General Assembly and signed by the Governor, and the Constitution of the Commonwealth of Kentucky, as amended. The law is also what was passed by Congress and signed by the President (The Defense of Marriage Act).
Those are the laws. A decision such as Obergefell vs. Hodges is entirely lawless, lacking both jurisdiction and authority, and it should be ignored by ANY official sworn to uphold the law and the Constitution.

This is how we have become what we have become - if one cannot win a war with a single battle, then don't fight the battle.
What does the author think will get used up in the battles that lead to eventual victory - can't run out of bullets or ideas but if we don't fight the battles there will be so much "precedence" that future battle will be rendered irrelevant and bullets will be the only thing left.
Kind of like a Star Trek soldier with atomic-powered laser weapons crying out "Keep your powder dry and don't fire until the enemy lays down and surrenders".

Rod Dreher is pathetic with this stream man argument, with a false choice. No one is proposing we die on this Hill. We should, however, stand firm with Kim Davis. There are many battles to be fought to win a war. No need to surrender preemptively on any of them.
