I’m not sure that this is the best argument against the concept of “hate crimes”. What distinguishes “murder” from “manslaughter”, for example, other that the perpetrator’s state of mind?
Quite true but we’ve always attemptted to determine intent.
We need better education in this society. If the shooter had known about the stiff hate-crime penalties, he might not have done it.
