I heard a former DoJ prosecter from Bush's term explaining the legality of this on Saturday night and he was saying how there was a way to consider him an "enemy combatant" but the administration would certainly not use it.
So- he fully expected the man to be Miranda'd and for him to do exactly what he just did: clam up. And- it went down EXACTLY as he said it would. Not sure it is as cut and dry as you seem to think it is. There are circumstances that when public safety is immediately threatened, the Miranda laws do not apply. I forget the exact term for it.
So, for instance, if the bomber had friends that were conducting more life threatening actions- like bombing trains in Canada to the U.S., we theoretically had every right NOT to Miranda him due to the clear and present danger. Now that we have, he can do more damage, simply by saying nothing.
Absolutely right! While I don't like the easy process by which Tsarnaev became an American citizen, the fact is that he is a naturalized citizen and is therefore entitled to every right thereunto pertaining until he is convicted of the crimes for which he is charged.
Wrongo Bongo. He is a freaking terrorist and was afforded all health care rights as a US citizen but the public exemption act was in place and this beyotch had him awakened so he could be “mirandized”. You can’t be questioned in a48 hour period if you are unconscious due to administered drugs.

I’m not. Where is that line drawn? Where does it stop? There is no set criteria for classifing someone an enemy combatant.

Well, any reference to previous FBI interviews or watch lists will be quickly ruled “prejudicial” and completely excluded. All pre-bombing government incompetence will be excluded. One million people ordered to shelter in place (martial law), that will be prejudicial too. CYA is looking ok all around -that’s what’s really important, that we get back to the “appearance” of security as soon as possible.
If the defense can call Mom then she’ll act crazy on que on the stand too garner sympathy for her son, with a Mom like that how couldn’t you be screwed up, right? Don’t discount it.

I’d love to strap Patreus, Ham and many many others into a chair and ask them where their loyalty lies and when they gave up. Especially Patreus.

However, they do have goodies they can offer him to get him to rat out his friends. The problem is that it takes time, and we do not have time while we are being attacked.
I think the intervention of a judge who had no business butting herself into a heavy investigation like this one gives Becks a lot of credibility now, in light of the fact that Joker clammed up. The left had some leverage in laughing at Beck, but that is gone now and Beck needs to take it and run with it for months.

I’m going out on a limb and saying that he probably doesn’t know much. Just following big brother.
Naturalization can be revoked.
Interrogation for information should have been completed before miranda. The information gathered would not be needed in prosecution.
He is on video planting a bomb that killed and maimed, threw bombs at cops, left bombs all over the neighborhood, etc. That’s more than enough to get him a death sentence or three.
Would be interesting to know more about this judge’s background.
If he does time rather than swinging don’t be surprised when there is a lethal incident in prison.
