When I waited tables many years ago at a similar establishment I quickly noticed two things. One, people in the smoking section always tipped better and were nicer. And two, when waiting on a table of black customers the slower and more relaxed my service was the better the tip I'd get. It seemed strange but I eventually chalked it up to their wanting to take their time eating and that if I was too attentive they felt I was trying to hustle them out the door to make room for some white patrons. But if they had busted a glass against the back of my head ... well let's just say I knew where the kitchen chefs kept the really BIG knives.

A witness said she saw three female customers get mad because the server was filling up their glasses with water too often.

I have a similar problem with waitresses constantly refilling my coffee, I cannot handle really hot food or drink and just when I've let it cool enough to take a few sips, she comes along to refill it and "warm it up".

I usually just respond with a polite no thank you, instead of letting her refill it, then throwing it at her.

The problem is criminal charges are filed by police or prosecutors. Besides, there isn't any $ in a criminal charge. Civil charges should be pursued with lotsa damages sought. The problem is, the likelihood of collecting is low.
