There is a critical difference. Concerning immigration law, what Obama is doing is largely doing nothing, or simply refusing to enforce existing law. Even his Dream Act by executive action is another act of refusing to take the steps prescribed by law.

With Obamacare, if that is struck down, he'd have to take many affirmative steps and have the funds to carry them out. And he'd have to win re-election to carry it very far.

With Obamacare, the funds have already been appropriated and authorized. That won't be a problem for the balance of this term.

I understand exactly how you feel. And if it is upheld Romney and the rest of the republicans won’t do a damn thing about it. They won’t defund it and Romney won’t issue waivers for all 50 states. And I suspect Romney is hoping it’s upheld so he can keep making that promise.

This country started it’s big downhill slide when idiots voted for obama and the SC and GOP allowed the Kenyan to take over. I fear it will never climb back up to be that “city on a hill”.

I don’t think the outcome matters in regards to November anywhere near as much as the response.

If the whole thing is struck down:
Obama has now accomplished nothing domestically; he’s supposedly a constitutional law professor and his major attempt at legislation was unconstitutional. He’s a failure.

OR, the partisan SCOTUS is legislating from the bench and the Left better fight as if their lives depended on it, because it really does.

If the whole thing is upheld:
The SCOTUS isn’t going to bail us out from stupid decisions, the Right has to fight as if our lives depend on it, because they really do.

OR, Obama was vindicated. The Republicans lied about its constitutionality. The Emperor really does have wonderful new robes.

If just the mandate is overturned, we’re left with an undeniable charlie-foxtrot and both sides will be super motivated to be the ones to clean up the mess.

So, pretty much no matter what happens, both sides can spin it to boost their side come November. (And I’m sure you can come up with lots of other arguments that I haven’t). The impact on November will come from who is better prepared to respond to the ruling, not necessarily on the outcome.

I don’t think anyone can really anticipate the type of civil unrest that may occur if the HC law is upheld.

Other than sound and fury signifying nothing . . . . . . there will be no civil unrest. We Americans have become too complacent about our liberties as long as American Idol has another season and NFL football season begins soon.

Too busy and can't be bothered, ya know.

Just because the results to these 2 cases have been announced consecutively doesn’t mean that they were decided in the same order. My understanding is that the court decided (i.e. votes) then the decisions, majority & minority, are written. That latter part is what takes most of the time after the completion of oral arguments.

I expect the individual mandate to go down in flames. The rest may be upheld but without a funding method — will collapse of its own weight.

He'll have to win re-election regardless. There are only just over four months until the general election. He'll have to win to even be in position to implement Obamacare through regulations should key provisions be shot down by the SC.

There’s no basis for Roe either. Or the eminent domain ruling not too long ago.

But this is over the top. If they want the court to ever be taken seriously ever again they can’t rule the government has power to force/demand citizens buy ANYTHING. It means just by living you have to buy something. Far more than a tax. Huge breach of liberty and free contract law. Involuntary contracts signed under duress, have always been regarded as null and void.

If the Founders didn’t use the Constitution in this way, what makes them think now in 2012 this is somehow a legitimate power of the federal government?

They will not uphold the mandate. The question is will they strike the entire law since they wrote it if any part if found invalid the entire thing is. I wish they would hold to the law as written (no severability) and have to strike the entire thing down. Even if they don’t it can’t work without the mandate so it goes down anyway as unworkable.

Today obama flipped off the SC and said he won’t abide by their decision to uphold even one part of AZ’s immigration laws. He’s going around it. He will do the exact same thing if the mandate is struck down.

Where's Obama going to get the money for such a flanking maneuver? It's one thing to create an executive order to tell a federal department to take thus-and-such action. It's quite another to FUND it. And if he does that, I expect they'll be lining up to impeach his marxist behind.

And remember you are asking the Court to 1) forget about the verbal bitch slap Obama gave them at the State of The Union and 2) ignore the “You better not overturn it bitches” warning he read them a couple months ago.

Liberal or not, the Court is not going to go out of it’s way to give Obama anything he wants if it makes them look like they are cowing under to the Executive Branch, as an “inferior” and submissive branch of government to the President.

Mandate is gone. Whether the whole law is is another matter.
