I have no problem with the US releasing these bad guys if the altitude is high enough.
Soldiers from the “other side” were released on condition that, once released, they would no longer fight in the war. If they were caught fighting again, they were supposed to be executed or otherwise severely punished.
It didn't work very well in the Civil War, either. Read this link — the practice in the South became to put “paroled” Southern troops back into the fight, but on a different battlefield where they probably would not be recognized if recaptured.

I have trouble seeing how this parole system would work in Afghanistan any better than in did during the Civil War, but I'm not sure I want to say it's treason when a century and a half ago it was standard practice in the United States.

As we capture any insurgents that are not killed in the act of capturing them, tell the taliban and al qaeda that for every American servicemember or civilian contractor killed by terrorists, five insurgents will be executed. Bomb a market or blow up a tank, we tactically nuke your training camps and villages with populations that are sympathetic to your cause... If it continues we will nuke Mecca..
