Should the Constitution be amended for Arnold?

Should the Constitution be amended for Arnold?

By Martin Kasindorf, USA TODAY

LOS ANGELES — Abolishing slavery. Giving women the vote. Establishing the income tax. Limiting presidents to two terms.

Through more than two centuries, it usually has taken a weighty cause to survive the burdensome process of amending the U.S. Constitution. Americans hold the work of the Founding Fathers in such reverence that they've added to it only 17 times since 1791. That's when the first 10 amendments were codified as the Bill of Rights.

Now, debate over a proposed 28th Amendment is focused on the popularity and political future of one man: macho Republican Arnold Schwarzenegger, the former bodybuilder and action-movie star who has been California's governor for barely a year.

With a bit of encouragement from the Terminator himself, some of Schwarzenegger's supporters are pushing for a constitutional amendment that would allow the Austrian-born governor to run for the White House as soon as 2008. Schwarzenegger is blocked by Article 2, Section 1, Clause 5 of the Constitution. It reads, "No person except a natural born citizen ... shall be eligible to the office of president." The 12th Amendment says the vice president cannot be foreign-born.

-SNIP-

But Sen. Dianne Feinstein, D-Calif., a Judiciary committee member, sees merit in the restriction. "I don't think it is unfair to say the president of the United States should be a native-born citizen," she said at the hearing. "Your allegiance is driven by your birth."

-SNIP-

Supporters of an amendment often note that the Constitution disqualifies from top offices immigrants who have shown loyalty in positions of public trust. Henry Kissinger (who was born in Germany), Madeleine Albright (Czechoslovakia) and Christian Herter (France) were secretaries of State. Retired Army general John Shalikashvili, a former chairman of the Joint Chiefs of Staff, was born in Poland.

Schwarzenegger gets the attention, but others in high offices could benefit from what has become known on Capitol Hill as the "Arnold amendment."

Michigan Gov. Jennifer Granholm, a Democrat, was born in Canada. (When online surfers reach amendforarnold.org, the Web site's message is a bipartisan "amend for Arnold and Jen.") Sen.-elect Mel Martinez, R-Fla., was born in Cuba. Labor Secretary Elaine Chao is from Taiwan. Rep. Pete Hoekstra, R-Mich., chairman of the House Intelligence Committee, was born in the Netherlands.

“The advertisement embraces the idea that Barack Obama was not born in the United States — a position rejected by most Americans. It’s bad for Barack Obama when even the black newspaper publishers of America think he is foreign born.”

LOL! This ad looks like it was prepared at the direction of the Obama White House for the 2012 campaign black outreach program! They are anticipating that Obama might be forced by a court, a state like AZ or public opinion to release the long form BC.

uncomfortable question;
Why is the “black community” so easily deceived?

“”We should hire three or four colored ministers, preferably with social-service backgrounds, and with engaging personalities. The most successful educational approach to the Negro is through a religious appeal. We don’t want the word to go out that we want to exterminate the Negro population. and the minister is the man who can straighten out that idea if it ever occurs to any of their more rebellious members.” Margaret Sanger

Here is TITLE 8 > CHAPTER 12 > SUBCHAPTER III > Part I > § 1401

§ 1401. Nationals and citizens of United States at birth

http://www.law.cornell.edu/uscode/8/1401.html

Nowhere is “natural born” defined.

Further, all of the citizenships defined therein are the result of a “statute,” and if it takes a statute to describe citizenship, that person is a “statutory” citizen and not a “natural born” citizen.

A statutory citizen (bestowed by man’s pen) can never be a “natural born” citizen (bestowed by God/nature).

Persons, eligible for the Office of the President of the United States (POTUS), NEVER have first generation ties to a foreign nation, whereas ineligible persons always do.

ALL statutory citizens are born with a tie to another nation by birthplace and/or blood, but NEVER is that the case with natural born citizens who have only American ties.

My God, those people are either corrupt as hell or are COMPLETELY STUPID.

Hey, black publishers... stop playing stupid! Natural Born citizen means, “Born under the sole jurisdiction of”. Two parents who are citizens, and born on our soil is the only way that specific condition can be met.

Obama FAILS.

Either you are corrupt and deliberately trying to teach black people lies, or you are STUPID. Which is it?

Wow...

It is a poker like tell or what?

Why run this ad with this claim unless you know something?

BTW, they misquote the Constitution...

Its “natural born Citizen” not “natural born citizen”. Capitalization matters.

That ad has a glaring error in it: Title 8, Sec. 1401 does not define "Natural Born Citizen", nor does it even use the phrase. What that statute defines is who is a citizen at birth, which is not the same thing. (And, incidentally, the earlier version of that statute, the one in effect at the time of Obama's birth in 1961, would not even have qualified Obama as a citizen at birth, if born abroad, because his citizen mother had not yet attained the age of nineteen and his father was never a citizen.)

The definition of "Natural Born Citizen," as understood by the writers of that phrase in the Constitution, comes from Vattel: a person who is born within the country to parents who are both citizens at the time of his birth.

Hard to tell if the error in the ad is deliberate or due to ignorance. In either event, it doesn't end the debate regarding Obama's constitutional qualifications to be president.

This is written in “lawyer speak” and is defensible. The central statement is, "The US Constitution does not require a candidate for the President of the United States to be born on US Soil." The constitution has requirements to be president not to be a candidate. Any ineligible fool can be a candidate.

In previous times one would not have expected the left to have the “audacity” to run an ineligible candidate, but this is just one more way for them to spit on the constitution. They not only want to destroy our country... they want to desecrate every shred, every piece of what has made her the greatest country in human history. Why? It is good vs. evil my friends. Those on the side of evil reveal themselves with this type of BS.

This ad was written to be deceiving from start to finish. Should this be the tactics of an organization representing our free press? This is just one more sign that the lefties have taken over nearly all Main Stream Media Organizations. The ends will always justify the means with these folks.
