Based upon what? What language in this bill gives them that recourse?

UCMJ is NOT civilian law.

Also, Repeal of “Don’t ask” means they can now be asked...
and the repeal of “Don’t Tell” does not change pre-existing code. The “Don’t Tell” aspect of Clinton’s policy was nothing more than a reinforcement of existing code.... so repealing it is moot without changing the UCMJ.

This is going to be funny when pro-gay prosecutors or defense lawyers try to use the removal of a policy to override the UCMJ. (unless of course the judge him/herself is a little light in the loafers)
