I asked for backup for the statement ""They registered THOUSANDS of babies between 1959 and some time in the 70’s and or 80’s if not LONGER, who were born overseas!!!" The program actually ran from 1911 until 1972. And I haven't yet seen your evidence for the "thousands." If you want to stop here, I understand.

Thanks, that pretty much what I thought, but it’s good to hear a lawyer’s take on it.

You are making the mistake I have repeatedly pointed out with regards to HIPAA. The individual can make anything public he wants, but the state is still obliged to protect the information, (as is a hospital.) And your (or my) version of “public interest” is not taken into account. It is the legal version or that specified in the statutes.

Examples for HIPAA might be releasing information to close contacts of someone with a highly communicable disease, for instance. “The public wants to know,” doesn’t count, or they’d have to release every detail of Lindsay Lohan’s hospitalization.

If you don’t want to do simple math you can stop right there.

Look it up for yourself, because you aren’t going to believe me.

Go research the welfare/Fed. school $$’s/all other federal program numbers funded by the US government and dependent on numbers of persons registered for them, and then compare them to the immigration numbers. Look in particular for the numbers of Parents who are Foreign born.

Now keep in mind homie, that Hawaii is doing all it can to obfuscate this.

Do it your self smarty pants. You pissed me off already, and I don’t feel like sharing any more of what I know from my EXPERIENCE of the place. I know what Hawaii is, and I know how things work there. It is perhaps one of the most corrupt states in the Union.

Knock yourself out bub. Re-invent the wheel. I actually hope you do, because I am more than a little sick and tired of trying to convince people like you who believe the best of the place, as if it was run ethically and with honor. It isn’t.

But you are gonna have to figure that out for yourself, because you clearly aren’t believing me or anyone else who has actual experiential knowledge of the place.

So have at it.

YOU prove ME wrong.

I wish you the best in that endeavor.

You are making the mistake I have repeatedly pointed out with regards to HIPAA.

We aren't talking about HIPAA, but the UIPA, which specifically protects HI state agencies for releasing information for which there is a significant public interest. You're making excuses when there is no need to make an excuse.

FYI ~~

December 21, 2010 at 12:46 am

I called Gen. Horst’s phone number as listed below, and they directed me to the PAO (Public Affairs Officer), Col. Robert Manning. The correct phone number to call is 202-685-4899.

Col. Manning said he has received about 300 calls today already (is that even possible at 12:30 EST??).

He reiterated to me that Dr. Lakin pled guilty to 3 charges and was found guilty of not obeying a lawful order from his DIRECT SUPERIOR OFFICER, and of the importance of order and obedience in the military.

I reiterated the initial case, which was the lack of a long form birth certificate, and how I hated to see such an unjust sentence (6 mos in Ft. Leavenworth, loss of retirement, and discharge from the military) for such an honorable officer.

I asked, at the very least, for suspension of the loss of retirement, if not suspension of the complete sentence.

Col. Manning listened patiently (and even once asked me to watch my tone – my ‘passion’ was showing), and said he would relay my message to Gen. Horst. He also said he welcomes phone calls and e-mails

(Robert.manning1@us.army.mil). He takes each one seriously. I plan to write an e-mail soon.

Thank you for caring.

Lakin Post-Sentencing Analysis

Upon hearing of the Lakin sentence, I thought it was a bit light on confinement, given that he’d skipped a 1 year deployment that 2 others had to fill (1 on very short notice).

On further analysis, I reasoned that the members had given the harshest, longest-impact option in the dismissal because that will preclude Lakin from seeing a dime of military retirement.

It also dawned on me that the members might have fashioned the sentence to confinement by showing a measure of compassion for the LTC’s stay-at-home wife and 3 young children. After all, the convening authority can give the forfeitures of pay and allowances to the family for up to six months.

Thanks very much. Six months. He’s gong to be all right. He took a stand and forfeited a lot, but he’s a better man for it, so long as he thinks it was worth it.
God bless him and his family. Remember them in our Christmas prayers.

UIPA makes specific exception for private information. Again, public interest doesn’t just mean, “people are curious.” Any lawyer would tell you that.

More than one, but they individually are paying the price so as to dissuade any others from following.

“...but they individually are paying the price so as to dissuade any others from following.”

Yes Danae, but Dr. Lakin, while we'll presume he wasn't a plant, only provided more misdirection for those who depend upon the “Ruling Class,” “The smart people,” to explain the truth. Dr. Lakin only ever stressed the hidden birth certificate. He did talk about ineligibility, but like Berg and World Net Daily, he helped the apparatchik distribute disinformation by never explaining that Chief Justice Morrison Waite, and Chief Justice John Marshall, and Chief Justice Charles Evans Hughes, and 14th Amendment originator, judge and congressman John Bingham, all told told us, using CJ Waite's words:

At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens...

All this energy about Lakin has sapped the growing clarity about who are natural born citizens and why our founder and framers required that our President and CinC be chosen from that majority of citizens. Obama, with a non-citizen father, is simply not a constitutional president. Politics has prevailed over law, all the way to the Supreme Court. The two Obama appointees have failed to recuse themselves. The court is corrupt. It is that simple.

Roberts is the likely holdout for reasons we probably will never know. Do powers in the Executive, Obama’s former CIA director, Brennan, certainly has files on everyone, know something about him? It doesn't matter. Our framers intended that the Constitution be understandable. It is. We know the history of the construction of the Constitution, of Jefferson's selection of Vattel’s Law of Nations for our first legal text book at our first law school. We know Hamilton and Washington regarded it as our most important source for legal philosopy (Hamilton's letter to Washington, Sept 15 1790).

Free Republic has a number of people who have studied the framers and their sources, but there are a remarkable number of agents keeping the conversation stupid. The idea is remarkably similar to the ploy used by Chester Arthur, who was also illegitimate because his father was a British subject when he was born - hide your birth certificate to keep the focus on the wrong crime.

Dr. Lakin may be an agent provocateur, or he may be a naive patriot. But he has not helped the public or the military to understand that his commander in chief and our President is illegitimate regardless of where he was born. And Lakin has probably succeeded in dissuading any other patriot from fulfilling his or her sworn oath to defend and protect the Constitution. You may recall that former Georgia Congressman Nathan Deal had the courage - the hidden letter from the Congressional Research Service shows that all Congressmen knew Obama had legitimacy problems, and the Senator, in particular, had all signed a resolution, SR 511, in which two citizen parents were deemed a requirement for natural born citizenship. Deal wrote a letter asking about Obama's legitimacy. His answer came as ethics charges for an old tax issue. He resigned and is now Governor of Georgia. Let's hope Georgia is one of those states which requires verification of eligibility before the next election. Want to bet?

We are close to becoming Venezuela, but the left didn't have the control of the voting process necessary to pass the Pelosi style of government to the red states - "vote for it so you can find out whats in it," knowing full well that in the blue states, and some of the red states, the SEIU controlled the ballot "count." Voting still matters in some states. Enough good citizens remain to chose different people to represent us in "The peoples house." Regardless, Obama is a fraudulent president, but was to have been our Chavez. His illegitimacy may have been part of the plan.

UIPA makes specific exception for private information.

Once information is made public, it's no longer private. Here's a legal opinion on a similar issue in another state:

"In consideration of the details that have already been published and made widely known to the public, it seems unlikely that records or portions of records pertaining directly to either of the deceased persons would, if disclosed, constitute an unwarranted invasion of personal privacy."

link to source

Again, public interest doesn’t just mean, “people are curious.”

This information relates directly to a constitutional requirement of public office that voters have a right and expectation to know. Requests aren't being made out of simple curiosity. You're making unnecessary excuses.

I don’t disagree with anything you have said.

The only truth I know other than Obama being an illegitimate pResident is that we don’t know everything going on. Maybe Lakin is a plant, but I doubt it.

I think he had a legitimate question and didn’t get it answered. It was also NOT the right question, but it is just about the same one we were asking in the spring of 2008.

We didn’t know then all the historical documents that would be found... shoot even Donofrio got hammered for taking the position he did, which was the same you listed in your post.

Obama is not illegitimate because of where he was born. Its because of who his FATHER is. Maybe Lakin knows that now, but could not put it into the record, because it wasn’t what he based his original decisions on. It was the basis he made his decisions on that he had to support and defend. I don’t think he had much of a choice once he decided not to follow his commander’s orders to appear, he had to stay on the course and back up his reasoning throughout.

A real dogs dinner that.

I saw what you wrote - because I don’t agree with you - MY HEAD ISN’T IN GEAR!! Just like a lib - agree with my propaganda or something is wrong with you.

YOU can’t make something legal when it’s illegal just because you ‘think’ or ‘write’ it - it’s backed by NOTHING. Do you get it now?
