I think that was an opinion not a fact necessarily. He based that opinion upon what he “thought” the court might consider. Bruce Fein was on Mike’s program earlier that day and gets deeper into the issues. I think anyone can bring a suit but as in Berg, the judge ruled he had no standing and threw the case out. Once Obama is sworn in, there is little anyone can or will do; perhaps Keyes’ suit will get somewhere; we shall see.
Bruce Fein said that any State Secretary of State could demand a birth certificate of the candidates in order to insure that the candidate had the necessary qualifications to appear on the State ballot. I don’t know if there are any agressive Secretaries of State out there or not. That could be a path to take for clarification of Obama’s birth certificate.
