I take that and if it was a 10 pound mirror that this tragic event would probably have had a happier outcome.

I haven't been in an accident, and am not planning to sue anyone, I have a lawyer, actually several, Wills, business, that kind of stuff.
having a lawyer is OK, calling him about wills, life insurance, also OK. Press conferences over the coffin, quoting your Lawyer during said press conference, Weird. JMHO

A lot of assumed facts here, true. But if an object is placed in such a way that it could do harm to anyone--child, shopper, employee--then the ownership of the store is responsible for those who made that possible. Unless the little boy had a good set of tools and knew how to use them or was swinging an 8 pound sledge, someone screwed up. Just as easily could have fallen when a sweet old lady in a motorized car hit it or any number of other events that could be reasonably expected to happen over the course of the life of the store. Something like a five year old boy probably doing what five year old boys often do is one of those things. Either the mirror mount was poorly designed , or it was not installed as designed or had been damged at some point and not repaired. Those who would blame it on the parent are just silly, which is about the tamest description I could muster.

A lot of assumed facts here, true. Yes there are, guess you assumed the boy was 5, when the fact is the boy that died was only 3 yrs. old.
He was accompanied by his 5 yr. old sister & mother.
Is WM at fault here ??? that's yet to be decided.
However, Most agree that no 3 yr. old should be out of the cart & roaming the store, while mother shops & also watches 5 yr, old.
Interesting that you call us *silly*, if we point out some of the Mother's own negligence......
What do you call this mother that is still "looking for funds to bury her child", that has already "declined to comment on the advice of their lawyer."
Since the mother admits to only HEARING this tragedy, obviously she was not watching BOTH of her children, while she also shopped.

I hate to inform you, but Starbucks would not exist if not for lefties swilling $4 cups of that coffee. Pardon me but I live in Portland, after moving here from Seattle. And while the pampered Lefties swill Starbucks Coffee by the gallons, I can mark on a map of both cities which locations are repeatedly atacked by hardcore Lefty terrorists. After the one on 26th and Division opened it was fire bombed at least twice. Go back and watch the Seattle WTO riots and tell me which shops were being destroyed. I dont argue that Starbucks is not a Left leaning corporation. But it is a corporation subject to the hate and violence of What Is Being Left, nonetheless.

More info has arrived since I first posted the Two person thing, that said a six foot tall mirror would be quite heavy, two people to move it is not unreasonable.
Darwin awards, well, that was kind of bad taste, can I plead lack of sleep?
Having a lawyer is not the problem, kind of like guns, it's not the gun, but how you use it. In this case it's not that they have a lawyer, it's what they are doing and how with him/her that matters
Either case, I think this is a tragic, event. (I can't imagine watching from five feet as my child dies.) I think Wall-Mart will settle out of court just to avoid the controversy.
I hope the family does not get a huge settlement, because Wall-Mart did not do anything that is uncommonly dangerous. maybe there will be a new regulation for floor mounted mirrors. Better yet, let insurance companies bill more for companies that don't take proper precautions.

You don't know so you jump to a conclusion. What an excellent way to feel superior and heap blame on someone who has just lost a three year old child.
Do you actually imagine you are the only one on FR who has raised children and that you are in a position to condemn anyone because you didn't have a child crushed by a falling mirror in a Wal-Mart store?
Your hubris is unpleasant to see on display.

I haven't read all 700 + posts so if this has been said, sorry. But a mirror in a Macy's dressing room fell and killed a little girl who was shopping with her grandma just about a week or so ago.

"Please do not play on or near mirror as it may cause injury or death". Having hung a few mirrors, I can only imagine what a 5' by 37 inches mirror weighs (assuming the "golden ratio"). Probably around 100 pounds.
Why would anyone leave a free-standing, unrestrained mirror that size where kids can get to it?
