I doubt this judge will go that far. He will just say Dover's efforts fail the Lemon test and therefore are unconstitutional. No "conservative" judge will stick his neck out that far. Judges hate to be overturned.
Now, a liberal judge is a total 'nother scary story....
Being that I have a belief in God, I certainly wouldn't want to bash religion. I guess I could say I believe there is an "intelligent design" to the universe, but that I certainly wouldn't try to argue that ID is a scientific theory (it most certainly isn't).
I think that's why ID is such a deceptively attractive philosophy, especially to laypersons who don't grasp the functionality of the scientific method. The basic problem, I think, comes down to scientific literacy; people who don't have a basic understanding of science are faced with the choice of whether or not to place their faith in science - to them it just comes down to a choice of one faith or the other, so why believe science when you can believe something that's more appealing and a lot easier to explain (even if it's totally wrong)?
