Are you really saying we should nominate Brown because she's like O'Connor?

It'd be better to have a proven conservative than Brown--I like her, but to my understanding, we know nothing about her on gun rights. Nothing.

Brown has a better chance of getting through, but I'd rather see a conservative nominee lying broken on the Capitol steps than see a closet gun thief on the court.

You mean like David Souter?

F that--if the nominee isn't a proven conservative there is no point to voting for the GOP. I'm sick of nominations like Kennedy and Souter where we think we'll get them through so they're nominated, and then do nothing but torch the Constitution when they get in.

We need certainty in that nomination or we're wasting the appointment. O'Connor must be replaced with a constitutionalist, not another O'Connor.

I was with you earlier, but here, we part ways. NO cases brought in state court are appealed to the federal appellate courts? What kind of attorneying do you do that you'd say that? That's complete horse manure. Just to start with, all kinds of habeas petitions from criminals are reviewed in federal courts after the criminals start appealing state court actions. Ditto state actions that have already been reviewed in state supreme courts!
