Irrelevant. The issues are as follows:
1. State Sovereignty
2. State Sovereignty
3. State Sovereignty
4. State Sovereignty
...
999. State Sovereignty
1000. State Sovereignty
Scalia is wrong; Thomas is right. It's that simple.

You know, it's hard to judge avery Supreme Court justice on one decision. Over the course of the years, every judge sitting on the Supreme Court has made some decisions that even his most ardent supporters don't agree with. Try to look at the big picture.

The big picture for Scalia is that he is authoritarian, knows no unenumerated rights, and buys in to the FDR Socialist coup against the Constitution.
That is a pretty big picture. He might make a decent second fiddle to someone keen on restoring us to the constitutional and legitimate path, but Scalia will not overturn the anti-constitutional New Deal era expansion of federal power.

On a $ide note, re$earch the po$ition $calia had before hi$ acen$ion on where he pimped a "living document" $lant of the Commerce Clau$e. You will then under$tand why he formed that "per$pective".
