And what a deal it was - lasted all of 48 hours. We were promised by McCain and the other six Neville Chamberlain Republicans that this would be a fresh start, save the Republic, return comity to the institution, blah-blah-blah. But our adversaries aren't interested in following deals. Hell, they are violating the Constitution when it comes to filibustering judges and 214 years of Senate tradition. But we're supposed to celebrate this? Now, they filibuster Bolton -- even while some had said that this deal would clear the way for his confirmation. Pathetic. Bainbridge is just another uninformed commentator with a website.

I found this argument pretty lame. He talks about the filibuster being constitutional - which is beside the point and is just a matter of opinion.

His next point is that the filibuster is a "conservative" device because it protects minority rights. His argument has no bearing on the filibuster of judicial nominees. All the filibuster does is enable 41 senators to block a presidential appointment. A minority can be used for radical ends to keep radical on the bench.

Just because something protects a minority or thwarts the will of the majority does NOT make it "conservative". The purpose of the judiciary is to protect the "minority" and according to Bainbridge is therefore "conservative". In fact, the judiciary has been over the last 50 years the most radical and anti-conservative branch of government. Its rulings have literally revolutionived this country. They overturned on a regular basis laww, traditions and customs, that have been in place for 200 years.
He also ignores the fact the the filibuster of judges is AGAINST 200 years of tradition and custom.

His final assertion are the most laughable. We need the filibuster to keep liberal judges off the bench. You mean like Beyer of Ginsburg? There is no doubt Reid would activate the nuclear in a second if the positions were reversed. And the Republicans have never filibusters left wing judges and wont in the future.
