We won't know who won until Frist pushes all the judges to a vote.

I agree. I'm withholding judgment until I see a filibuster and the reponse of the Republican majority, including the seven deal makers. I suspect that Lindsey Graham, at least, has been so thoroughly whipped he will return to support Frist.
