Yes he could!
This might be why:

I just called my Senator's office (Richard Burr, NC), and told the young man who answered the phone that I support the so-called "nuclear option" to end fillibusters of judicial nominees. The young man said, "well, that's a switch!"
They are getting INNUNDATED with calls against this. The Left is mobilized on this one. CALL NOW!!! Get the phone numbers here: http://www.senate.gov/ (Click on "choose a state")
The Judiciary is a MESS. We desperately need honest judges. If Bush needs 5 Democrats to go along with any judge (or SCOTUS Justice!) that he appoints, then HOW are we ever going to get integrity restored to the judiciary?
The Republicans never fillibustered Clinton's appointees. The Constitution REQUIRES the Senate to consider these nominations. These fillibusters are stopping the Senate from doing its constitutional duty. They must stop. CALL YOUR SENATOR NOW!!

the people who really need to hear from us are:
Chaffee, RI
Collins, Maine
Snowe, Maine
McCain, AZ
Hagel, NE
Specter, PA
there are 55 GOP senators, but if all of those 6 defect, than there are only 49 votes.
Nelson of Nebraska is an option to pick off a Dem vote if needed.
