Let us review the unprecedented wording of Judge Greer's Feb. 25, 2005 court order:

ORDERED AND ADJUDGED that absent a stay from the appellate courts, the guardian, Michael Schiavo, shall cause the removal of nutrition and hydration, from the Ward, THERESA SCHIAVO, at 1:00 p.m. on Friday, March 18, 2005.

(Feb. 25, 2005 order to remove nutrition and hydration)

Unqualified nutrition and hydration definitely does not mean medical treatment. Nutrition and hydration must be "medicalized"—delivered to the patient via medical assistance— to legally qualify as medical treatment.

Therefore, since Judge Greer's Feb. 25th court order does not call for the removal of medical treatment or anything that qualifies as medical treatment, it does not legally apply to Terri and her court determined wishes for the removal of medical treatment! This gross "error" must be publicized immediately.

I understand judges must make those decisions, but even the most superficial look at what he didn't allow in (coincidentally 90% of it was from Terri's parent's side), it's hard not to conclude there was bias. We're not talking about dividing up grandma's estate here, Terri was a living, breathing human being, he was literally deciding whether she would be allowed to continue living. She had committed no crime, she was an innocent with no voice, but with the same constitutional rights as you or I. As a matter of fact, he was constitutionally mandated to be sure her rights as a handicapped person were not violated under the American with Disabilities Act. Given that, Greer had an extra responsibility to Terri. There's a reason most courthouses have a statue or carving of justice blindfolded and holding a scale. Greer had the blind part right, but failed miserably when it came to balancing the scales.

If I had any doubts about his lack of concern for Terri or her rights they were dispelled with his last 2 rulings. Even if you believe he ruled correctly when ordering her death you can't deny the cruelty he exhibited, and I can't for the life of me figure out why. Just because her guardian made a request doesn't mean he had to grant it. He denied her the constitutionally guaranteed right to worship without government interference (supposedly he doesn't even have the authority to do this, but he did) by denying her communion as she lay slowly starving to death. There was NO good reason legal or otherwise to deny her this small connection to humanity, her church and her God. She was a devout Catholic and these are the rites of her church and are sacred. If that wasn't enough, he granted MS permission to have her cremated (while allowed by the church, many Catholics are still uncomfortable with it) and sent to Pennsylvania so that even in death she would be unable to be mourned and cared for by her friends and family. These are not unbiased rulings and would in no way violate his death ruling. She would still die on schedule, just with a little more compassion. Instead, she died with her "husband", a man who could barely hide his contempt for her in public and his freaky lawyer for whom the "death process" was practically orgasmic at her side. I can barely comprehend any of this it's so disgusting.

Hmm, I wonder if Kerry plans something final for the missus if she is unlucky enough to fall into a coma. Depends on the prenup, her will, and her kids' attentiveness to her well being.

Former Schindler attorney Pat Anderson told Hannity today that the Medical Examiner has announced that there will be no independent examiners at the autopsy---apparently he's in charge and intends to be solely in charge.

Oh no. What I feared most.

Public oratory often serves as a subterfuge that disguises the fact that the speaker lacks the courage to move beyond words and into action. I don’t believe we have ever witnessed more ‘brave words’ in combination with a sickening lack of comensurate ‘brave actions’ than we have over the past two weeks of symbolic outrage on the part of our national leadership. The special session of congress that was called two weekends ago may go down in history as one of the most appalling examples of meaningless political theatrics ever concocted by leaders whose outrage is skin deep, at best, and who value charisma and facade infinitely more than character.

I wouldn't change a word.

Fat Teddy never disappoints. He is such an embarrassment. With his ex falling down in the street the other morning, you have to wonder if he didn't spare a passing thought about Terri and Joan/the ex, and 'what if's.

The law says there has to be "clear and convincing" evidence that this is what she wanted.

Clear and convincing is necessarily a somewhat subjective judgement, but I seem to recall that Schiavo and at least one of his relatives came forth to testify to her wishes, while the Schindlers were unable to find anyone to directly refute it. "I heard her say it" will beat "That doesn't sound like something she'd say" pretty much every time. I may be misremembering the record, though - I trust you'll correct me if so.

Terri Schiavo Relatives Feud Over Burial

Friday April 1, 2005 1:01 AM

By MICHAEL RUBINKAM

Associated Press Writer

LEVITTOWN, Pa. (AP) - Terri Schiavo's ashes will be buried in an undisclosed location near Philadelphia so that her immediate family doesn't show up and turn the burial into a media spectacle, a member of the Schiavo family said Thursday.

``If Mike knew they would come in peace, he would have no problem with it,'' Scott Schiavo, Michael Schiavo's brother, said during an interview at his home.

After an autopsy, Michael Schiavo plans to have his wife's body cremated and her ashes brought to Pennsylvania, where she grew up. Scott Schiavo said the ashes would be buried in a plot left by an aunt and uncle, but the family does not plan on providing the specific location for the burial - underscoring the bitterness of the dispute.

Her parents, Bob and Mary Schindler, had fought for years to prevent her feeding tube from being removed, and they opposed cremation and wanted her buried in Florida.

A spiritual adviser to Terri Schiavo's parents, Paul O'Donnell, said they plan to hold a Roman Catholic Mass without her body sometime next week. Asked about perhaps never knowing where his sister might be buried, Bobby Schindler said, ``We've already said goodbye. ... He's been doing this kind of stuff for 15 years. What would make him stop now?''

As he monitored TV news reports from the kitchen of his small house in the Philadelphia suburbs, Scott Schiavo received a stream of calls Thursday from people denouncing him and his brother. On his answering machine was a lengthy message from a man from Texas who, shouting obscenities, called the Schiavo family murderers.

``This isn't over by a long shot. We're going to get our name right,'' he said. ``The world is going to know who Mike was, they're going to know Mike wasn't a beast. ... We're going to clear his name, and point it right back at the Schindlers, to let people know just who Bob Schindler is, what type of person he is.''

Police made visits Thursday to both Scott Schiavo's home and the home of his brother, William, in Philadelphia, as a result of threats to the families.

At Terri Schiavo's alma mater, Archbishop Wood High School in Warminster, workers changed a sign that read ``Terri Schiavo, Class of 1981, We pray that you may live'' to ``We pray that you rest in peace.''

God rest Terri's sweet, brave soul. I am glad she is free and pray that she enjoy the blessings of heaven.

May her "husband" never know freedom or peace until he repents and apologizes to her parents and siblings for the reprehensible way he has treated them.

The Schindlers had her best friend come forward and SHE had heard her state otherwise.

Don't you think that Terri's ordeal coming to an end during Easter season and the Pope's deterioration and similar medical treatments is more than a coincidence? We are certainly being warned. On Rush this afternoon, a woman with an Oriental accent called, worried that the US would be hounded and slammed at the next World Human Rights meeting, coming up soon. Assuredly, we'll see large posters of Terri and US Killer of Innocents! in big red letters across her face.

I have mixed feelings about that--I want to believe any decent human being who took the time to read the facts of the case did wake up; we get the picture, in other words, of a gross injustice done to this poor woman. Then again, I am still burning inside that the MSM doesn't show the pictures of 9/11; the people jumping to their deaths. We need to be angry about these things and not become complacent. And then I think of the family and how they might feel violated by these pictures being publicized, and am unsure. If people don't wake up now to a judiciary gone mad with power, and a culture of death which cheapens all of our lives, when will they?

The decapitation videos are something that needed to be seen, to wake up those that like to swept islamofascism under the rug. That sort of horror must not be hidden so people can pretend it didn't happen- like the MSM not wanting to show the people jumping from the WTC. Not the same thing at all as a tabloid publishing private/personal pictures.
On second thought maybe they should publish pictures if there are any. Maybe people need to be reminded starving to death is no way "peaceful" or "beautiful".

"President Bush could have at the 11th hour issued an Executive Order overturning everything and giving her guardianship to her parents..."

That wouldda been a deathblow to the Rule of Law and the separation of Powers, imho...the Executive and Legislative Branches gave the Judicial Branch every possible opportunity to save Terri's life, and they stubbornly REFUSED!! The Judiciary wanted Terri DEAD and they got their wish!!
