Last I heard, in court, you can be convicted of shooting an intruder, unless your life was in danger. If you could run out the back door, or climb out a window, you need to let the perp have his way.
Actually, here in Florida, we have the legal theory of "Castle Defense". We are not required to flee our homes. Once you are in your home you have the right to defend yourself. You can stand your ground even if the back door is open and you could flee.

Having gone through Andrew, this is a very stupid thing to do. Why protect property that will be replaced by insurance? In fact if I go through this again, I would happily help the looters get my stuff.Very responsible, contributing member of society. Clearly.

"Surface collection" of personal property is a recognized southern tradition, and in most southern states, it is written into law. I don't know about Florida, but unless it is clearly posted "no trespassing" and locked or chained across a driveway, surface property retrieval is perfectly legal. In NC, the law even goes so far as to protect the homeowner from lawsuits if the retriever is harmed during his brief "enjoyment" of the property.
