No, threatening someone is assault. Physically harming them is battery.

(Not a law student... this semester. Next semester, God willing, I will be, but that's another matter for another day.)

Now, as for your utterly inane argument -- shooting an home invader can be assault if the homeowner cannot reasonably justify that he feels an imminent danger to life or limb. Mere invasion into the house does not suffice. There has to be mitigation.

You break into my home and I guarantee that I'll feel threatened.

IIRC in certain jurisdictions the "mere" fact that you've broken in creates a presumption of threat. In others, well, it ain't rocket science. Only a complete fool would not recognize the threat.
