I'm not rich, but pay tremendous amounts in insurance costs for healthcare, in case some buffoon sues my doc.

Seems to me Loser pays would protect ME, by lowering my insurance costs.

Same with homeowner's insurance. If some bufoon burglar slips on my driveway, his greedy ambulance-chasing lawyer sues my insurance company. Once again, my rates go up.

Seems to me that Loser pays gives legal protection FROM lawyers, which is what the middle class needs.

Just for everyone's information, Greta Van Susteren's husband was one of the lawyers involved in the lawsuit against McDondalds.

As was Banzhaf - the slimeball that help create the attack on the tobacco industry.

I have no love for the tobacco industry but despise people like this because in the end their target is not the "product" or "industry" but the consumer.

You've overstated the tobacco companies' deceptions as do all antis. Without that particular belief, which has not been shown by the published "secret tobacco documents," most if not all the lawsuits against them would have been thrown out just like this one was. Mark Twain talked about people who bemoaned the use of tobacco back in 1865, long before there was a tobacco industry; Lucy Page Gaston started the Chicago Anti-Cigarette League in 1897 and at the turn of the century, 14 states outlawed the sale and use of tobacco products; O. Henry used the term "coffin nails" in 1906; in 1943 Hitler's doctors established the link between smoking and cancer; in 1955 Reader's Digest published "Cancer by the Carton"; in 1964 the Surgeon General's Report made it official. Don't even try to imply that people didn't know tobacco use could be harmful to their health. And they still--even today, with virtually no advertising and a worldwide attempt to "denormalize" smoking--people start and continue to smoke.

Grow up and get off the hate smoker band wagon.

they would be shunned by their peers - but to this day there are still many doctors who disagree with the PC blather about smoking and exposure to second hand smoke.

Have you seen every internal memo that McDonald's ever put out? If you haven't you can't say they didn't do anything, can you????

Strange enough, a year after our 100% ban, our health department claimed that smoking is increasing to epidemic proportions, apparently nearly 50% of teens now smoke..... smoking issue front and center 24-7 for years ...... and it's unintended consequences.

attorney Samuel Hirsch filed other, similar lawsuits last year

As long as scumbag lawyers like this one can file such suits with impunity, the nation is doomed.

This creature should be slapped with a huge fine for filing a frivolous suit.
