The Ninth Circuit Got It Right
The Wall Street Journal ^ | September 18, 2003 | LAURENCE H. TRIBE
Posted on 09/18/2003 3:11 PM PDT by Beelzebubba
It's wrong to hold an election if some voters will be disfranchised.
There is palpable hypocrisy in the complaints one hears about the Ninth Circuit Court of Appeals' decision in the California gubernatorial recall. People moaned and groaned about a hanging chad here and a dimpled chad there in Florida in the election of 2000 and succeeded in getting the federal judiciary to throw away thousands of ballots still uncounted as of an arbitrary date (Dec. 12, 2000). Their complaint was with the randomly distributed risk that similar-looking ballots would be read differently at different times or places given that Florida law refused to impose any uniform and objective formula for translating ambiguously punched ballots into definite votes....

I thought the GOP convention ended
At his press conference today on political reform, Arnold Schwarzenegger was asked a question he had to have expected, about the casino Indian tribes bankrolling commercials for Tom McClintock. The question gave Arnold the perfect opening to talk directly to the voters about the very issue he was discussing while at the same time taking a swipe at his last remaining major Republican opponent. He could have used the moment to say how this showed that the Indians have become the biggest, baddest special interest in Sacramento, and that by helping McClintock and Bustamante both they were playing a cynical game and proving that he, Schwarzenegger, is the man the special interests fear most. Instead, he gave reporters, and by extension readers and television viewers, a political consultants answer questioning McClintocks loyalty to the Republican Party....

McClintock did not identify Burton by name, but he said in an interview later that day that he had talked to a congressman about the campaign. After summarizing for the lawmaker Schwarzenegger's positions on various issues, McClintock said, he had won a convert.
"You're doing the right thing," he quoted the congressman as saying. But....

Gasoline Lines for California? (if Bustamante gets elected)
CATO Institute ^ | Sept. 19, 2003 | Alan Reynolds
Posted on 09/18/2003 9:20 PM PDT by FairOpinion
California Lt. Gov. Cruz Bustamante is campaigning for his boss's job with the logically impossible theme of "No on Recall, Yes on Bustamante." Until very recently, there was no visible difference between the policy plans of Gov. Gray Davis and Mr. Bustamante -- i.e., to tax and spend with abandon. But now there is one big difference. And that difference reveals that Mr. Bustamante is, remarkably, even more incompetent than Mr. Davis when it comes to dealing with economic problems....

Question time
AP has moved a story saying Bustamante, McClintock, Camejo and Hufffington are drafting a letter in which they will threaten to boycot next week's debate unless the sponsors drop 12 questions submitted by the public and already released and use a traditional format instead. It's not clear from the story whether the letter will really come together. There seems to be some question whether all the candidates are really willing to threaten to drop out. Stan Statham, president of the California Broadcasters Assn, says the format will not change....
