Am I reading the bill right or wrong? HR760 defines a partial birth abortion as being a vaginally delivered birth in which the head is entirely out of the mother's body, or in the case of breech birth if the baby is delivered past the navel.

Is there a risk that the physician can around this ban by preventing the head from coming all the way out of the mother, insert the scissors in the top of the skull instead of at the base of the skull, and suck out the brains before the head clears the birth canal? Yes? No?

Would the physician be committing a criminal act if he did the above?

It's worse than that, it's government approved and encouraged murder. Thanks to Democrats. It's the baseline of their party platform and their litmus test for judges. If you are not an abortionist, you are unfit to serve (according to the Democrats).

it's the only way possible to dig ourselves out of the current liberal/socialist/marxist hell. I want Liberty restored in my lifetime. There's no way that's gonna happen with the Democrats in charge.

Only one thing to do. Continue building on the Republican majority while eliminating the Rinos as we can in the primaries - without turning the majority control back to the Democrats.

Yep .. it's the only way to get this country back on track

It's a rough road ahead, but it can be done and issues like PBA can be finally settled once and for all

Also, suprising as it may seem, many folks don't understand what PBA is all about .. we need to educate the public as well

Holding on to the White House, increasing the Republican majority, and replacing as many liberal activists from the judiciary as humanly possible is MY burning passion for the next several years. IMHO, it's the only way possible to dig ourselves out of the current liberal/socialist/marxist hell. I want Liberty restored in my lifetime. Abortion in any form was never an option for us. We lost a daughter at birth in 1966. If that were a different day and age, we would probably have been encouraged (though it wouldn't have changed our minds) in 1969 to not have the strong-willed, independent, beautiful, conservative, intelligent, work-ethicized, and downright ornery 34-year-old daughter and 3 grandkids today. She had the same problem that our daughter in heaven had but was saved by a 75% burned Vietnam returnee and his willingness to donate blood to save this little spark of life. God bless you, brother, whereever you are.

SEC. 4. SENSE OF THE SENATE CONCERNING ROE V. WADE.
(a) FINDINGS- The Senate finds that--

(1) abortion has been a legal and constitutionally protected medical procedure throughout the United States since the Supreme Court decision in Roe v. Wade (410 U.S. 113 (1973)); and

(2) the 1973 Supreme Court decision in Roe v. Wade established constitutionally based limits on the power of States to restrict the right of a woman to choose to terminate a pregnancy.

(b) SENSE OF THE SENATE- It is the sense of the Senate that--

(1) the decision of the Supreme Court in Roe v. Wade (410 U.S. 113 (1973)) was appropriate and secures an important constitutional right; and

(2) such decision should not be overturned

That is Democrat Harkin's amendment, and will be stripped out of the final bill:


H.R. 760/S.3, Partial Birth Abortion Ban The bill, sponsored by Rep. Steve Chabot (R-OH) and Sen. Rick Santorum (R-PA), would prohibit the procedure commonly known as partial-birth abortion. Although previously vetoed by President Clinton, President Bush has promised to sign the bill. On March 13, S. 3 passed the Senate 64 to 33 (Senate Roll Call Vote 51).

Sen. Tom Harkin's amendment expressing the Sense of Congress reaffirming Roe v. Wade was attached the S. 3 by a vote of 52 to 46 (Senate Roll Call Vote 48). The Harkin amendment will be stripped in conference once the bill passes the House.

Nope, there are several alternatives. Just as the House under Hostetler's amendment is defunding the federal courts from enforcing rulings banning the Decalogue in State Court Houses the states, particularly Nebraska and Texas, should simply tell the SCOTUS to pound sand.

The States can simply ignore the SCOTUS and force the issue to a head. Just as in the service there is no need to obey unlawful orders, there is no requirement to obey anti-constitutional rulings from philosopher kings.

Chances of that happening? Very small, but perhaps there is a Hostettler in a state capital somehwere.

Don't fall for the anti-Republican propaganda.

48 Republicans did not vote for that amendment.

The Republicans want a ban on partial birth abortion (actually a ban on all abortion, but it starts here). The Democrats inserted the Harkin amendment as a "killer" amendment to attempt to kill the bill. Almost all of the Democrats voted for the Harkin amenmendment and almost all of the Republicans voted against it.

Now it has to go to a joint House-Senate conference where the Harkin killer amendment will be stripped out before the final bill is passed.
