If the vast majority of a state believes it is wrong, why shouldn't they pass laws against it? Because the acid test is whether someone's rights are being violated. If they're not, then the state has no legitimate reason to criminalize the behavior.
I find chewing with an open mouth extremely offensive. If I can convince the legislature to criminalize that behavior, is it legitimate to do so? Most people would agree with me that open-mouth mastication is gross and wrong.
Of course not - although I'd love to throw my ex-wife, whose eating habits make a pig look refined, in jail for it.
