You guys can't see past your noses to understand what could happen here. If Torvalds and other Linux gatekeepers are held civilly liable for introducing patented/copyrighted code into Linux -- regardless of whether they did it intentionally -- the whole house of cards is going to tumble. Nobody wants to be held personally liable for this.

If it's not demonstrably all IBM's code to a 51% or better certitude (civil laws standard), IBM has a strong... nay, a TITANIC patent portfolio and will likely use it in a countersuit to force cross licensing with SCO. The reason, of course, is that SCO probably can't tell when it stepped in IBM patent doodoo. You like that system, well don't blame IBM if it exploits it.

Naive. Cross-licensing is only interesting assuming that SCO wants IBM's patents. Which it could care less about. It wants IBM's money.

IBM can shut down SCO on the basis of infringing IBM patents. If SCO wants to fall on its sword rather than cross-license, so be it.

RedNeck I've already said several times the larger issues are much more important than this particular trial. Linux, by it's funky name already, is becoming known as 'pirateware' whether you like it or not. As far as the side I'm on, we'll be glad to keep defending US trade secrets from you 'pirates'.

That is ridiculous, mate. Not all of these people were blind IBM partisans. We don't see any of them screaming and countersuing IBM, no they are sitting calmly because they KNOW what the scene will be when the dust will settle.
