Having said all that, take the case of California. If admissions were strictly on the basis of academic competence, the classes would be about 50% Asian, 45% Anglo, and 5% other, maybe. In a state where about half the residents are Hispanic or Black, the net result is that public support for elite public higher education would arguably be eviscerated over time, and these institutions really are a generator of economic growth.

I'm not sure an evisceration over time is likely. The JCs are filled with blacks and Latinos. Even if they are underrepresented at the UC level now, over time those JC students (or their children to whom they've passed the value of education) are going to filter in to the UC or Cal State systems.

Dear sir, I would not have brought up the issue of race had you not made what you suggest was a humorous statement that whites are afraid. I found that offensive and since I did not know that you were trying to be funny, I responded. Frankly, I may have a horrible sense of humor, but I don't even see what is funny or a propos.

If I offended you by saying rights don't exist...let me repeat the context--the post which answered your question:

I'm not sure if you are being sarcastic, but if you are being sincere, there is your answer. Governments must be defined and instituted among men in order to ensure those inalienable rights. Until an objective set of laws is made manifest through a constitution, those rights cannot be defended or "secured." An objective set of laws requires an orderly government. The aboriginies in any land do not possess title to the land they live upon. In fact, their lawlessness is one of their defining characteristics...which is why our settling of the West was so bloody.

A far cry from your original statement denying the existence of rights sans government.

Rights exist with, or without government.

Government can only do two things: defend those rights, or violate them.

I'm not often a fan of Michael Kinsley, but he got it right about the odious, purposely muddled O'Connor opinion which will chain us to terribly unfair college admissions practices for decades to come.

A disgraceful decision. The fact that the majority opinion was penned by a Reagan appointee is just galling.
